The Portuguese Government has recently approved a new legal regime for remote working in public sector entities, addressing the urgent need to regulate a work model that has gained prominence in the post-pandemic landscape. This legislation aims to standardize practices across State institutions, ensuring a transparent, equitable, and sustainable approach to remote work.
Among the key elements introduced are clearly defined eligibility criteria, structured application and approval procedures, and minimum technical and organizational conditions for adopting telework. The law also requires public bodies to carry out regular assessments on the impact of remote work on institutional performance, productivity, and employee well-being, encouraging data-driven adjustments and improvements.
One of the most relevant developments is the reinforcement of the right to disconnect, now enshrined in law to protect workers’ rest time and promote better work-life balance. Additionally, the legislation ensures equal opportunities between on-site and remote employees, particularly in terms of access to training, career advancement, and participation in internal activities.
This new framework marks a major step toward a more modern, adaptable, and results-oriented public administration, where telework is no longer treated as an exception but as a legitimate and integrated form of working—supported by clear rules and strategic vision.
